Legal Notice
These Legal Notices (hereinafter the "Legal Notices") are intended to inform users of the website https://celyse-4.myshopify.com (hereinafter the "Site") of the identity of the entities responsible for the publication and hosting of the Site, as well as the general conditions governing access to and use of the Site, in compliance with applicable European Union and French legislation.
Article 1 - Site Publisher. The Site is published by CÉLYSÉ PARIS (hereinafter the "Publisher"). For any question, request for information, or complaint relating to the Site, users may contact the Publisher by electronic mail at the following address: info@celyseparis.com. The Publisher undertakes to process any request addressed to this electronic mail address within a reasonable timeframe, without however being able to guarantee a specific response time. The Publisher is solely responsible for the editorial content published on the Site and for the products and services offered thereon.
Article 2 - Site Hosting. The Site is hosted by Shopify Inc., a company incorporated under the laws of Canada, whose registered office is located at 151 O'Connor Street, Ground Floor, Ottawa, Ontario, K2P 2L8, Canada. Shopify Inc. provides the technical infrastructure necessary for the operation of the Site, including server hosting, data storage, and network connectivity. For any question relating to the hosting of the Site, users may contact Shopify Inc. through the contact information available on its website at https://www.shopify.com. The Publisher disclaims all liability for any interruption, malfunction, or unavailability of the Site attributable to the hosting provider, to maintenance operations, to failures of the telecommunications network, or to any other event beyond the reasonable control of the Publisher.
Article 3 - Intellectual Property. All elements of the Site, including but not limited to the general structure, the graphic design, the texts, the images, the photographs, the videos, the sounds, the logos, the trademarks, the icons, the software, the databases, and the underlying source code, are the exclusive property of the Publisher or of its licensors and are protected by the applicable provisions of French and international intellectual property law, including the French Intellectual Property Code (Code de la propriete intellectuelle), European Union directives and regulations, and international conventions relating to copyright, trademark law, design law, and patent law. Any reproduction, representation, modification, publication, adaptation, distribution, or exploitation, whether in whole or in part, of any element of the Site, by any means or process whatsoever, without the prior written authorization of the Publisher, is strictly prohibited and constitutes an infringement punishable by the applicable criminal and civil penalties. The trademarks, trade names, logos, and domain names of the Publisher appearing on the Site are the exclusive property of the Publisher. Any unauthorized use of these distinctive signs constitutes an act of counterfeiting and/or unfair competition giving rise to the civil and criminal liability of the infringer. Article 4 - Terms of Use of the Site. The user undertakes to use the Site in accordance with the applicable legislation and with these Legal Notices, and to refrain from any use of the Site that is unlawful, abusive, fraudulent, or likely to infringe the rights of the Publisher or of third parties. Article 5 - Limitation of Liability. The information and content available on the Site are provided on an "as is" and "as available" basis, without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or availability. The Publisher endeavors to ensure the accuracy and currency of the information published on the Site, but does not guarantee that such information is free from errors, omissions, or inaccuracies. The Publisher disclaims all liability for any damages, whether direct, indirect, incidental, special, consequential, or punitive, arising from or relating to access to, use of, or inability to access or use the Site, or from reliance on any information or content available on the Site, even if the Publisher has been advised of the possibility of such damages. The Publisher's total aggregate liability arising from or relating to the Site shall in no event exceed the greater of one hundred euros or the total amount paid by the user to the Publisher in the twelve-month period preceding the event giving rise to the claim. The limitations of liability set forth in this article shall apply to the fullest extent permitted by applicable law and shall survive the termination or expiration of these Legal Notices.
Article 6 - Personal Data and Privacy. The Publisher collects and processes personal data relating to users of the Site in accordance with its Privacy Policy, which is available on the Site and constitutes an integral part of these Legal Notices. The Publisher is committed to protecting the privacy and the personal data of users of the Site in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, hereinafter "GDPR"), French Law No. 78-17 of 6 January 1978 relating to data processing, files, and freedoms (Loi Informatique et Libertes), as amended, and any other applicable legislation on the protection of personal data. Article 8 - Applicable Law and Jurisdiction. These Legal Notices are governed by and construed in accordance with applicable European Union consumer protection legislation and French law, insofar as the user is a consumer habitually resident in France. In the event of a dispute relating to the interpretation, validity, or performance of these Legal Notices, the Parties shall endeavor to find an amicable solution. In the absence of an amicable agreement, any dispute shall be submitted to the competent courts in accordance with the applicable rules of territorial jurisdiction under French consumer law. In accordance with the provisions of Regulation (EU) No. 524/2013, consumer users are informed that recourse may be had to the European online dispute resolution platform. Consumer users may also refer the matter to the competent consumer mediator in France, in accordance with Articles L. 611-1 to L. 616-3 of the French Consumer Code.
Article 9 - Modification of the Legal Notices.
